Review of Pensions and Social Justice: Obstacles, Strategies, and Perspectives for Social Security Law

Abstract

This article analyzes the legal, doctrinal, and practical foundations of pension reviews in the Brazilian social security system, considering their importance as an instrument of social justice and the enforcement of fundamental rights. The research is based on the hypothesis that social security reviews not only correct administrative distortions but also strengthen social protection and promote greater equity in the granting of benefits. The legal aspects provided for in Law No. 8,213/91 and Decree No. 3,048/99 were examined, in addition to the interpretations established by the higher courts, such as in Themes 975 and 1,102. The study highlights the main types of review, the challenges faced by insured persons—such as bureaucracy, institutional resistance, and misinformation—and the opportunities brought about by digitization, advisory law, and the use of technologies applied to the CNIS and social security calculations. The methodology used was qualitative, with documentary, jurisprudential, and bibliographic analysis. As a result, it proposes the integration of social security review with compliance and corporate social responsibility practices, also suggesting future empirical studies to measure socioeconomic impacts. It concludes that the review of pensions represents not only a subjective right, but a strategic tool for the realization of citizenship and social security justice in Brazil.
